In a cross-border trademark infringement case, the Delhi High Court issued an injunction in favor of the Gujarat Cooperative Milk Marketing Federation’s (GCMMF) Amul, against the Italian company Terre Primitive. The Italian firm had been marketing cookies and chocolate-covered biscuits under the name “Amuleti,” a mark found to be similar to Amul’s renowned trademark.
As per reports, GCMMF filed the suit through its counsel Abhishek Singh. He highlighted that Amul is a well-known household name in India with a strong global reputation, ranking 8th among the top dairy organisations worldwide.
Singh argued that Terre Primitive had “blatantly” copied the script, style, and representation of “Amul,” merely adding the word “eti” to the mark.
Justice Mini Pushkarna issued an injunction restraining the Italian firm from using or dealing with any marks identical to “Amul.” The firm was also directed to remove the infringing products from its website. Additionally, Meta was ordered to block or delete the Italian firm’s social media accounts that promote these products, reports stated.
Jayen Mehta, Managing Director of Amul (GCMMF), described the order as a relief for Amul and a significant precedent in safeguarding indigenous brands against foreign infringement.
The next hearing of the case is scheduled for January 7, 2025.
