Delhi High Court Restrains 15 Pizzerias For Infringing Domino’s Trademark

The court, while granting an interim injunction in favor of the global pizza chain, noted that the infringing names were phonetically and visually similar, potentially misleading consumers and compromising food safety standards.

The Delhi High Court has issued a restraining order against 15 pizzerias for infringing on the trademark of Domino’s Pizza, highlighting the potential risks to public health if such imitation continued.

As per media reports, Justice Saurabh Banerjee was presiding over a case filed by Domino’s Pizza, sought a temporary injunction against these businesses for using names strikingly similar to its own, such as “Domnic’s Pizza,” “Dominic Pizza,” “Dominic’s Pizza,” “Domnik Pizza,” and “Daminic Pizza.”

In its May 28, 2025 order, the court observed that the defendants’ brand names were clearly and confusingly similar, both in appearance and pronunciation, to the original Domino’s name, which was formerly “Dominick’s Pizza.”

Given that the case involves food products, the court emphasised that the standard for proving deceptive similarity is lower than for other types of goods. The court noted that confusion in such cases could pose serious risks to human health, necessitating a stricter evaluation and a more vigilant stance, as per media reports.

Accordingly, the court temporarily restrained the 15 outlets and their associates from using the infringing names until the next hearing, scheduled for September 17, 2025.
