Vadilal Drags ITC To Court Over ‘Fantastik’ Trademark Dispute

Vadilal has sued ITC over the use of the 'Fantastik' trademark, alleging it is deceptively similar to its 'Funtastic' brand and seeking an injunction and Rs 1 crore in damages.

Vadilal Drags ITC To Court Over 'Fantastik' Trademark Dispute

Ice cream maker Vadilal International has filed a trademark infringement suit against ITC in a commercial court in Ahmedabad, alleging that ITC’s use of the ‘Fantastik’ mark for chocolates and confectionery has been deceptively similar to its ‘Funtastic’ brand for ice creams. The company has sought a permanent injunction restraining ITC from using the mark and has claimed Rs 1 crore in damages for alleged business losses.

The legal action has come after more than a year of communication between the two companies, as per media reports. The commercial court has sought ITC’s reply to Vadilal’s notice of motion and has posted the matter for further hearing on July 9.

According to Vadilal’s advocate Zahid Shaikh, the company had first become aware of ITC’s ‘Fantastik’ mark in March 2025 and had found it to be phonetically and structurally similar to its own ‘Funtastic’ trademark. Vadilal had subsequently issued a cease-and-desist notice to ITC before approaching the court.

In its suit, Vadilal has stated that it has been operating in the ice cream and confectionery business since 1907 and has been using the ‘Funtastic’ brand for more than two decades. The company has also submitted sales figures for the brand dating back to 2002 and has stated that its products have been sold across India and exported to markets including the US and Singapore.

Apart from seeking to restrain ITC from using the disputed mark, Vadilal has also sought delivery of allegedly infringing materials, rendition of accounts and protection against dilution of its brand.

The company has also informed the court that it has challenged ITC’s registrations for the ‘Fantastik’ trademark and has initiated rectification proceedings before the Trade Marks Registry in Kolkata.
