Parle Agro has filed a trademark infringement suit in the Delhi High Court against PepsiCo, seeking to stop the use of the word “Fizz” for its 7UP drink. The matter came up before Justice Tejas Karia and will be heard next on August 18.
As per media reports, Parle claims it launched Appy Fizz in 2005, making “Fizz” a prominent and essential part of its brand identity. The company says PepsiCo has now adopted “Fizz” in an identical style and presentation, reducing the size of the 7UP logo and giving “Fizz” prime placement on its packaging.
Parle alleges this move is aimed at copying its branding and capitalising on its goodwill. PepsiCo, on the other hand, reportedly argued that “Fizz” is a generic term for aerated drinks and cannot be monopolised.
The case has also seen legal teams from Khaitan & Co representing Parle, and JSA representing PepsiCo.
