The Delhi High Court has closed a trademark infringement suit filed by Nestlé S.A., the parent company of Maggi, after it entered into a settlement with Shankeshwar Utensils & Appliances, which manufactures utensils under the mark “Maggisun.”
Justice Tejas Karia decreed the suit as the defendant undertook that it will not manufacture or sell pressure cookers or any other goods under the trademark “Maggisun” or any other mark identical or similar to Nestlé’s “Maggi.”
As per media reports, the defendant company has acknowledged Nestlé as the proprietor of the trademark MAGGI and confirmed the validity of all its trademark registrations. It has also undertaken not to advertise MAGGISUN, MAGGI, or any similar trademark on any media, including print, electronic, social media, or e-commerce platforms in the future.
Further, the defendant has agreed to destroy all pressure cookers and other goods bearing the trademarks MAGGISUN, MAGGI, or any similar mark. It has also committed to cancel the trademark registration for “Maggisun.” Nestlé’s counsel stated that the remaining prayers in the suit will not be pressed if the decree is granted as per the settlement.
“The Suit is decreed in terms of the Settlement arrived at between the Parties as recorded above. Let the Decree Sheet be drawn up accordingly. The Parties are directed to be bound by the terms of the Settlement,” the Court said.
