The Delhi High Court has granted relief to Amazon Technologies, a subsidiary of Amazon Inc., in a trademark infringement case.
A division bench stayed a previous single-judge order that had directed the company to pay approximately Rs 340 crore (USD 39 million) in damages to Lifestyle Equities over alleged infringement involving the Beverly Hills Polo Club trademark, as per media reports.
The interim order, passed by Justices Hari Shankar and Ajay Digpaul, clarified that Amazon is not required to make any pre-deposit for the stay to remain in effect. However, Amazon must submit an undertaking agreeing to satisfy the damages if the court ultimately rules against it. The bench further stated that the current findings will have no bearing on the final outcome of the appeal, the reports added.
The dispute began in 2020 when Lifestyle Equities initiated a trademark infringement suit against Amazon Technologies and others, alleging unauthorized use of its registered “BEVERLY HILLS POLO CLUB” logo/device marks. The claims included that Amazon was manufacturing and selling products under its “Symbol” brand featuring a deceptively similar mark. Additionally, Cloudtail India, operating on Amazon.in, was also named for selling the allegedly infringing products.
On October 12, 2020, the High Court had initially issued an interim injunction restraining Amazon and other parties from using the disputed logo and instructed Amazon Seller Services to delist the infringing products. Subsequently, Amazon Technologies failed to appear in the proceedings and was dealt with ex-parte.
