The Delhi High Court has directed an inspection of Shark Tank-featured footwear brand Bacca Bucci following a lawsuit filed by Skechers, which alleges that the company copied its shoe designs.
As per media reports, Justice Tushar Rao Gedela granted Skechers an ex-parte interim injunction and appointed local commissioners to seize infringing products.
The Court noted that the designs are “nearly identical” and “deceptively similar”, highlighting a strong likelihood of consumer confusion.
Skechers USA and its affiliates have approached the Delhi High Court against Bacca Bucci Fashions, alleging infringement of the sole design of their “Go Walk 5” shoes.
The plaintiffs stated that they hold registered design rights for both the midsole and outsole of the product, which was introduced in the Indian market in 2019. They further asserted that the design has garnered significant goodwill over time, and claimed that Bacca Bucci’s footwear reproduces key distinctive elements, including horseshoe-shaped structures, segmented patterns, and asymmetrical block formations.
A cease-and-desist notice was issued in August 2025, and a subsequent reminder was also sent; however, the defendant failed to comply.
The Court restrained Bacca Bucci from manufacturing, selling, advertising, or offering the shoes for sale across platforms, including online channels. It further directed the company to recall the products, disclose details of its supply chain, and submit a full account of the profits generated from these shoes.
The Court further appointed Court Commissioners, granting them authority to undertake a comprehensive inspection and enforcement exercise. Their mandate includes visiting Bacca Bucci’s premises across Delhi, Gurugram, and Noida; entering and inspecting the facilities and goods therein; and seizing shoes bearing the impugned designs, along with associated packaging, labels, brochures, and other marketing materials.
They are also authorised to prepare a detailed inventory of all seized items, examine books of accounts such as invoices, sales records, and ledgers, and document the proceedings through photographs and video recordings. Additionally, the Commissioners may identify any further storage locations and extend the scope of the search accordingly, seek police assistance where required for execution, and, in the event of resistance, break open locks to carry out their duties.
