The Delhi High Court has asked Ambuja Cements and JSW Cement to resolve their ongoing trademark dispute concerning the use of the word ‘Kawach’ through mediation.
As per media reports, Justice Manmeet Pritam Singh Arora has issued summons to JSW Cement and its subsidiary JSW IP Holdings, directing both companies to explore the possibility of an out-of-court settlement. The matter has been listed for further hearing on October 15, should mediation not succeed.
Ambuja Cements has sought to restrain JSW from using the term in its newly launched product ‘Jal Kavach’, arguing that it infringes upon the ‘Ambuja Kawach’ trademark, which has been registered and used since 2020 for its water-repellent cement. The company has maintained that the rival product’s branding, including references to “water resistance,” “seepage prevention,” and “durability,” has been designed to capitalise on the reputation of its existing Kawach product.
JSW Cement has recently launched ‘JSW Cement CHD Jal Kavach’ and filed for trademark registration in May this year, which Ambuja claims overlaps with its prior use and market presence.
