In a fresh case of brand identity dispute, Campus Activewear has filed a trademark infringement suit against Campus Sutra, accusing the fashion label of unauthorized use of its registered mark “Campus” in several product listings.
The Delhi High Court heard the matter on July 15. According to reports, the sportswear company has sought a permanent injunction to prevent Campus Sutra from using the mark and to restrain further trademark and copyright infringement.
During the hearing, Campus Sutra’s legal team told the Court that only three of the brand’s 11,000 total designs inadvertently featured the word ‘Campus’, and that the products in question had been listed online unintentionally.
“We have written to various platforms to remove the listing of these products,” the Court was informed.
Justice Amit Bansal, who presided over the case, noted the submissions and recorded that the defendant (campus sutra) would refrain from using ‘Campus’ on its own in any future product communication until further orders.
“Mr Amit Sibal also submits that the defendant has been using the mark ‘CAMPUS SUTRA’ for its apparel since 2012. However, the defendant has never used the ‘CAMPUS’ mark for footwear. Without prejudice to the rights and contentions of the defendant, Mr. Sibal submits that till the next date of hearing, the defendant shall not use the mark ‘CAMPUS’ on a stand-alone basis, in respect of any of its products,” the court order stated.
The High Court has issued a notice to Campus Sutra and will consider Campus Activewear’s plea for interim relief on November 10.
